1. About these Terms
These Terms and Conditions (“Terms”) apply when you access or use the Salventia website, applications, booking interfaces, customer-support channels or related services (together, the “Platform”). The Platform is operated by Phai Tech LLC (“Salventia”, “we”, “us” or “our”).
By creating an Account, submitting a Booking Request or confirming a Booking, you confirm that you have read and accepted these Terms. The Privacy Policy and Cookie and Similar Technologies Policy explain how personal data and tracking technologies are handled; they do not replace these Terms.
If a mandatory consumer-protection rule gives you rights that cannot legally be excluded or limited, that rule prevails over any inconsistent part of these Terms.
2. Definitions
“Account” a registered user profile on the Platform.
“Booking” a confirmed reservation for a Provider Service.
“Booking Confirmation” the written or electronic confirmation showing the Provider, dates, price, payment schedule and applicable conditions.
“Booking Request” a request submitted through the Platform before the Provider confirms availability.
“Platform Services” the search, comparison, communication, booking-support and payment-arrangement functions supplied by Salventia.
“Provider” an independent hotel, health resort, rehabilitation facility, wellness provider, accommodation business, transfer provider or other supplier listed on the Platform.
“Provider Service” the accommodation, wellness, rehabilitation, recovery, hospitality, transport or related service supplied by a Provider.
“Provider Terms” the Provider’s conditions for a specific offer, including payment, cancellation, no-show, age, occupancy and property rules.
“Reservation Prepayment” an amount paid to Phai Tech LLC to confirm a Booking, forming part of the Total Price and reducing the balance payable to the Provider.
“Total Price” the total mandatory amount displayed for the selected Booking, excluding optional items and separately disclosed charges.
“User” or “you” any individual who accesses the Platform or makes a Booking for themselves or another person.
3. Salventia’s role
Salventia provides a technology platform that allows Users to search, compare, request and, where available, book Provider Services. Providers are independent businesses and are responsible for supplying the Provider Services they advertise.
Unless the Booking page expressly states otherwise, the contract for the Provider Service is concluded directly between you and the Provider when the Booking is confirmed. Salventia is not the owner or operator of the Provider’s property and does not supply the underlying accommodation, wellness, rehabilitation or recovery service in its own name.
For certain Bookings, Phai Tech LLC may arrange or collect a Reservation Prepayment as an authorised collection intermediary for the Provider. This does not make Salventia the supplier of the Provider Service.
Commercial arrangements between Salventia and a Provider, including the Provider’s remuneration of Salventia, are separate from your Booking. They do not increase the Total Price unless an additional charge is expressly disclosed before confirmation.
4. Eligibility and accounts
You must be at least 18 years old and legally capable of entering into a binding contract to use the Platform independently. A parent or legal guardian must make any Booking involving a person under 18.
You must provide accurate, complete and current information. You are responsible for maintaining the confidentiality of your Account credentials and for activity carried out through your Account, except where caused by Salventia’s breach of duty.
Tell us promptly if you believe your Account has been compromised or used without permission.
5. Non-medical nature of the Platform
Salventia does not diagnose medical conditions, prescribe treatment, determine medical indications or contraindications, provide emergency care or replace advice from a licensed healthcare professional.
Search results, descriptions, filters, comparisons and Platform communications are provided for travel, accommodation and service-navigation purposes. They must not be treated as a medical diagnosis, medical recommendation or guarantee of a health outcome.
The current Platform is not designed to receive or process medical records or health information. Do not upload or send diagnoses, test results, prescriptions, medical reports, scans or other information about health through ordinary Platform forms, chat or customer support. If a Provider requires such information, it must be exchanged directly with that Provider using a channel controlled by the Provider.
The Platform is not intended for emergencies. Contact the appropriate local emergency service or a qualified medical professional if urgent assistance is required.
6. Search results, rankings and Provider content
Search results may be influenced by the criteria you select, availability, price, location, quality and completeness of Provider information, popularity, user ratings, commercial cooperation and operational performance. Sponsored or promoted placements will be identified where applicable.
Providers are responsible for the descriptions, images, facilities, programme details, availability, restrictions and other content they supply. Salventia takes reasonable steps to present information accurately but cannot independently verify every statement in real time.
We may correct, remove or suspend information that appears inaccurate, unlawful, misleading or inconsistent with Platform standards. If you notice a material error, please report it to Customer Support.
7. Booking process
A Booking Request is not a confirmed Booking and does not guarantee availability.
Before confirmation, you will be shown the Provider, dates, principal services, Total Price, amount payable now, balance payable to the Provider, and the applicable Provider Terms.
A Booking becomes binding when you receive a Booking Confirmation, unless the confirmation expressly states that an additional Provider approval is required.
You must review the Booking Confirmation immediately and report any discrepancy without undue delay.
Special requests are not guaranteed unless the Provider confirms them in writing.
8. Prices, taxes and currencies
The Total Price and payment schedule displayed before confirmation form part of the Booking. Mandatory taxes and charges known to Salventia will be included in the Total Price or clearly identified as payable separately.
Optional services, local charges that depend on actual use, security deposits and charges imposed directly by third parties may be payable separately when clearly disclosed.
Where a price is displayed in a currency different from the Provider’s settlement currency, the displayed conversion may be indicative. Your bank or payment provider may apply its own exchange rate or foreign-transaction fee.
If an obvious technical or pricing error is discovered before the Provider Service begins, we may ask you to accept the correct price or cancel the Booking for a full refund of amounts paid through Salventia. We will not rely on this clause to correct ordinary commercial price changes after a valid Booking has been confirmed.
9. Payments
9.1 Full payment to the Provider
For some Bookings, the full price is paid directly to the Provider. The Provider or its payment processor is responsible for charging, confirming and refunding that payment under the Provider Terms and applicable law.
9.2 Reservation Prepayment to Phai Tech LLC
For some Bookings, you pay a Reservation Prepayment to Phai Tech LLC and pay the remaining balance directly to the Provider. The Reservation Prepayment forms part of the Total Price, is not an additional charge, and reduces the amount due to the Provider by the same amount.
Before confirmation, the Platform will show the Total Price, the Reservation Prepayment payable now, the balance payable to the Provider, the payment currency and the applicable cancellation and refund conditions.
Where stated in the Booking flow, Phai Tech LLC accepts the Reservation Prepayment as an authorised collection intermediary for the Provider. Payment of that amount discharges your payment obligation to the Provider to the same extent.
9.3 Card and payment credentials
Salventia does not collect or store the full payment-card number, CVV/CVC or other sensitive authentication data. Where payment details are required, you provide them directly through a payment interface controlled by the Provider or its payment processor. Salventia may receive limited transaction information such as the amount, currency, status, masked payment reference and transaction identifier.
You must use a payment method that you are authorised to use and ensure that sufficient funds are available. Suspected fraud or unauthorised use should also be reported promptly to your bank or payment provider.
10. Provider terms and special requests
Provider Terms shown before confirmation are incorporated into the Booking. They may cover cancellation deadlines, no-show charges, deposits, occupancy, minimum age, check-in requirements, accepted payment methods, property rules, accessibility and other conditions.
You are responsible for reviewing Provider Terms before confirming the Booking. If Provider Terms conflict with these Terms on the supply of the underlying Provider Service, the more specific Provider Terms apply, subject to mandatory law and the protections expressly provided by Salventia.
Requests concerning diet, room location, accessibility, transfers or other preferences are requests only until confirmed by the Provider.
11. Changes, cancellations, refunds and no-shows
Changes, cancellations, refunds, late arrival, early departure and no-show consequences are governed by the separate Cancellation, Refund and No-Show Policy and the booking-specific conditions displayed before confirmation. Both form part of your Booking.
If the Provider cancels a confirmed Booking or the Booking cannot be confirmed after a Reservation Prepayment has been collected, amounts paid to Phai Tech LLC for that Booking will be refunded in accordance with the Cancellation, Refund and No-Show Policy and mandatory law.
12. User responsibilities
- Provide accurate names, contact details, dates, guest numbers and other required Booking information.
- Review travel-document, visa, insurance, transport and entry requirements independently unless Salventia expressly agrees to provide a specific service.
- Comply with Provider Terms and ensure that other persons included in the Booking do the same.
- Obtain permission before providing another person’s personal data and inform that person about the Salventia Privacy Policy.
- Contact the Provider promptly if you expect to arrive late or cannot use the Booking.
- Use the Platform lawfully and in good faith.
13. Communications
We may send service communications required to operate the Platform or manage a Booking, including verification messages, Booking confirmations, changes, payment notices, reminders, security alerts and responses to support requests.
Salventia does not currently use your contact details to send direct-marketing or promotional communications. If this changes, a separate notice and any consent required by applicable law will be implemented.
Communications between you and a Provider may pass through the Platform. We may use automated security tools to detect spam, fraud, malware or unlawful content, but we do not use ordinary Booking communications for direct marketing.
14. Reviews and user content
If you submit a review, image, message or other content, you confirm that it is accurate to the best of your knowledge, relates to a genuine experience, does not infringe another person’s rights and is not unlawful, deceptive, threatening, discriminatory, defamatory or promotional in disguise.
You retain ownership of your content but grant Salventia a worldwide, non-exclusive, royalty-free licence to host, reproduce, translate, format, moderate and display it for operating and promoting the Platform. The licence ends when the content is deleted, except for copies lawfully retained for compliance, evidence or backup purposes.
We may remove or restrict content that violates these Terms or applicable law and may provide a reasonable channel to challenge a moderation decision.
15. Prohibited use
- Interfering with security, availability or operation of the Platform.
- Introducing malware, automated scraping, denial-of-service activity or unauthorised access attempts.
- Using bots to create Accounts, submit false requests or manipulate rankings or reviews.
- Collecting personal data of other Users without a lawful basis.
- Impersonating another person or using false payment or identity information.
- Using the Platform for unlawful, fraudulent or abusive activity.
- Uploading medical records or health information through functionality not specifically designed and authorised for that purpose.
16. Intellectual property
The Platform, Salventia brand, software, interface, databases, design and original content are owned by or licensed to Phai Tech LLC and are protected by applicable intellectual-property laws. You receive a limited, revocable, non-transferable licence to use the Platform for personal and lawful booking purposes.
You may not copy, reverse engineer, resell, frame, systematically extract or commercially exploit Platform content without written permission, except where mandatory law permits otherwise.
17. Platform availability and changes
We aim to keep the Platform available and secure but do not guarantee uninterrupted operation. Maintenance, upgrades, security incidents, network failures or events outside reasonable control may temporarily affect access.
We may modify, suspend or discontinue Platform features. A change to the Platform will not alter the confirmed price or booking-specific conditions of an existing Booking unless required by law or agreed with you.
18. Disclaimers
Provider Services are supplied by independent Providers. Salventia does not guarantee that a particular Provider Service will achieve a specific health, wellness, rehabilitation or recovery outcome.
User ratings and reviews express individual opinions. They do not constitute professional, medical or legal advice.
Nothing in these Terms excludes warranties or protections that cannot legally be excluded.
19. Liability
Each Provider is responsible for the proper supply of its Provider Services and for acts or omissions of its personnel. Salventia remains responsible for its own Platform Services, including the correct handling of amounts it receives and obligations that mandatory law places on it.
To the maximum extent permitted by law, Salventia is not liable for indirect, consequential or purely economic loss that was not reasonably foreseeable when the Booking was made, or for loss caused by inaccurate information supplied by a Provider where Salventia did not know and could not reasonably have known that the information was inaccurate.
To the maximum extent permitted by law, Salventia’s aggregate liability arising from the affected Booking will not exceed the amount paid to Phai Tech LLC for that Booking. This limit does not apply to fraud, wilful misconduct, gross negligence, death or personal injury caused by Salventia, breach of confidentiality or data-protection obligations where liability cannot be limited, or any other liability that applicable law prohibits us from limiting.
20. Complaints and dispute handling
Submit a complaint through Customer Support and include your Booking reference, a clear description of the issue and relevant evidence. We may need to share the complaint with the Provider to investigate and resolve it.
We will acknowledge and handle complaints within a reasonable period. Where the issue concerns the Provider Service, Salventia may facilitate communication but does not replace the Provider’s legal responsibility.
You may also use any complaint, mediation, consumer-protection or court procedure available under mandatory law.
21. Suspension and termination
We may restrict or suspend an Account or Platform access where reasonably necessary to protect security, prevent fraud, comply with law, investigate abuse or address a material breach of these Terms. Where appropriate, we will provide notice and an opportunity to respond.
Account suspension does not cancel a confirmed Booking unless the Booking is itself fraudulent, unlawful or otherwise subject to cancellation under the applicable Booking conditions.
22. Changes to these Terms
We may update these Terms to reflect legal, operational or Platform changes. The updated version will state its effective date. Material changes will be notified through the Platform or another reasonable channel before they apply.
Unless mandatory law requires otherwise, the version accepted when a Booking was confirmed continues to govern that Booking.
23. Governing law and mandatory consumer rights
These Terms are governed by the laws of New Jersey, USA, without excluding mandatory consumer-protection, e-commerce or data-protection rules that apply in the country where you reside or receive the Provider Service.
Subject to any non-waivable right to use local courts or consumer procedures, disputes relating to Salventia’s Platform Services will be submitted to the competent courts of New Jersey, USA. Disputes relating to the underlying Provider Service may also be subject to the Provider Terms and the law of the place where the Provider Service is supplied.
24. Language
These Terms may be provided in English, Arabic and other languages. The English version is the reference version unless mandatory local law requires the Arabic version or another version to prevail. The original Arabic text of applicable GCC legislation prevails where the relevant law so provides.
